2.1 Agratech NW Ltd grants you a non-exclusive licence to use this website upon the following Terms and Conditions.

2.2 We may terminate this licence at any time without notice.

3.1 This website contains material which is owned by or licensed to the Operator. This material includes, but is not limited to, the design, layout, look, appearance and graphics. It is protected by intellectual property laws including, but not limited to Copyright.

3.2 You may view, use, download and store the material on this website for personal use or for the purpose of conducting business with us. Commercial use is not permitted. The re-distribution, re-publication, or otherwise making available of the material on this website to third parties, without our prior written consent is prohibited.

3.3 Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.

6. Liability

6.1 We do not guarantee that use of this website will be compatible with all hardware and software which may be used by visitors to the site.

6.2 Except as set out in Clause 6.3, we will be under no liability to you whatsoever whether in contract, tort (including negligence), breach of statutory duty, restitution or otherwise for any injury, death, damage or direct, indirect or consequential loss (all three of which terms include, without limitation, pure economic loss, loss of profits, loss of business, depletion of goodwill and like loss) howsoever caused arising out of or in connection with the use of this website or the use, accessing, downloading or relying on any information or other materials contained in this website, including, without limitation, as a result of any computer virus.

6.3 These Terms and Conditions do not exclude our liability (if any) to you for personal injury or death resulting from our negligence, for fraud or for any matter which it would be illegal for us to exclude or to attempt to exclude our liability.

6.4Purchases of Pesticides - The purchaser and/or end users of the pesticide products being purchased are responsible for ensuring that these products are used in line with current industry Approved Codes of Practice and therefore Agratech NW Ltd does not accept any liability whatseover.  All operators must be certificated and trained in using and applying any Ministry Approved professional product. Please ensure that you use plant protection products safely. Always read the label and product information prior to each use. Please be aware that by proceeding with any order you are purchasing a professional pesticide product and must ensure that the end user of these products complies with the DEFRA/HSE Code for the Safe use of Pesticides.

6.5 We endeavour to dispatch your order to you within one working days, subject to the receipt of cleared funds (We no longer accept cheques as payment for any orders). However, because delay is sometimes outside of the Company's control, time of delivery shall not be of the essence. As such, the Company shall not be liable for any losses, costs, damages, charges or expenses caused by any delay in the delivery of the products. For orders where courier delivery is selected, If you have not received the products within 5 working days you may contact the Company by email quoting your order reference number and we will investigate and liaise with you. For orders where Royal Mail delivery is selected, If you have not received the products within 10 working days you may contact the Company by email quoting your order reference number and we will investigate and liaise with you. 6.6 It is the responsibility of the customer to inspect the products on receipt. The Company will not be liable for loss or damage during transit unless you notify the Company in writing (including email) of the nature of the damage within 3 working days of the date of delivery. Such notification should include photographic evidence of both the damaged product(s) and packaging. The liability of the Company will be limited to the replacement of products damaged or lost, or will credit you with the value of lost or damaged products at the Company's discretion. Under no circumstances shall the Company be liable for consequential loss or damage arising from loss or damage occurring in the course of carriage.

6.7 Failure to advise the Company of non-delivery of goods within 10 days from date for delivery specified in the order will relieve the Company of all responsibility and liability for loss. 

6.8  The Purchaser shall inspect the goods immediately on the arrival thereof and shall within 3 days from such inspection give notice in writing to the Company of any matter or thing by reason whereof he alleges that the goods are not in accordance with the contract if the Purchaser shall fail to give such notice the goods shall be deemed to be in all respects in accordance with the contract and the Purchaser shall be bound to accept and pay for the same accordingly.

b) It shall be the Purchaser's responsibility to return alleged defective goods to the Company at the Purchaser's expense. The Company will not be liable for any non receipt of returned goods at Agratech NW Limited premises.

6.9 Please be aware that items such as nozzles, spraytips, fertiliser caps etc will be sent in their own sealed plastic bag and are deemed to be precision items. Therefore please ensure that you inspect the goods prior to opening the sealed bag as once opened, such items will not be returnable or refundable.

Goods ordered in error, or are simply returned, because you have decided you do not want the goods after delivery, will be subject to a restocking fee of 20%, plus the outgoing postage costs, which will be deducted from your refund.

All UK, orders placed on the website, were payments are made via the Stripe payment gateway, and the customer then requests the order be cancelled and refunded, or incorrectly orders an item, and subsequently returns the unused item, for a refund, will be subject to a deduction of the Stripe processing fee of 2.5% plus £0.20.This figure will be rounded down to the nearest full penny.

Where a product has been shipped direct from a supplier, and returns of those products, for whatever reason, will be subject to the suppliers conditions of return, and will need to be returned to the supplier, as per the suppliers instructions.

Most suppliers we use, will issue a "Goods returns Note & Number" and will not accept any return without such information included. 

Upon acceptance of the return, it will at the suppliers discretion, as to the refund of the cost to us, of any returned goods, returned to our suppliers. No refund will be given to any customer, for any returned goods, until a credit note has been issued to us, by the said supplier, and any deductions, applicable, will be deducted from your refund. 

The Stripe card processing fee and outgoing carriage charges are non refundable. 

NB:- Shipping charges deducted from refunds, may be higher, than, that actually charged on the website, at the time of purchase, and will reflect the actual cost of shipping the product to you. 

Your refund will take 10 working days, and will be credited back to the card used for the original payment. Orders placed from overseas, this fee will be higher and will vary dependant upon the country were the order was placed. 7.0 All lengths of cut hoses, are deemed as special order items, and are non cancellable once cut, and they are non returnable if incorrectly ordered by the customer.

7.1 Purchases made by customers from outside the UK may be liable for import duties and taxes in the customers own country. Agratech NW Ltd does not apply any taxes or import duties, to any products we sell to customers outside the United Kingdom. Any taxes and import duties that are applied, when the goods arrive in the purchasers country, are the sole responsibility of the purchaser.

7.2 Collect In Person is for use by customers who wish to place their order online, and pay for said purchase in full at point of order. Customers who have chosen Collect In Person, can then visit our premises and collect their purchase. 

Where this option has been chosen by overseas customers who cannot collect in person, and have used this option, to enable them to complete an order, whilst our over seas shipping is suspended, the order will be cancelled and refunded and will be subject to an admin fee of 10%, which will be deducted from any refund given.

7.3 In placing an order with us, you warrant that you are qualified in the use of, an safe disposal of pesticides in accordance with FEPA.

7. Privacy

Our Privacy Statement forms part of these Terms and Conditions.

8. Complete Agreement

These Terms and Conditions (including the Privacy Policy referred to in Clause 7) contain all the terms which you and the Operator have agreed in relation to the use of the website.

9. Jurisdiction and Acceptance

This website is controlled and operated by Agratech NW Ltd, from our offices in England. The formation, existence, construction, performance, validity in all aspects whatsoever of these Terms and Conditions or of any term of these Terms and Conditions or any dispute in relation to the materials contained in this website shall be governed by English law. The English courts shall have exclusive jurisdiction to settle any disputes which may arise out of or in connection with these Terms and Conditions or use of the website.

9.1 Your continued use of this website indicates your acceptance of these Terms and Conditions.

10. Product Warranties & Guarantees

1. When making a purchase from Agratech NW Ltd, by any means, the customer accepts the terms and conditions, in full, of any, warranty or guarantee, that is solely provided by the Manufacturer of the product, or the UK importer of products, where said products are manufactured overseas. Any exceptions to this will solely be at the discretion of Agratech NW Ltd. These warranties are offered by the manufacturer or importer and not by Agratech NW Ltd.

2. Warranties do not include carriage charges that may be incurred, where a product is either replaced, or repaired as per any manufacturer or importers terms and conditions. Any exceptions to this will be at discretion of Agratech NW Ltd.

3. Warranties do not include automatic replacement of any product, where the product has been supplied new, and is subsequently faulty for whatever reason. 

4. All warranties and Guarantees are solely provided by the Manufacturer or UK importer, of all products purchased from Agratech NW Ltd by whatever means.
