Terms of Trade

Please read these terms carefully as they are the terms under which the customer ("you") agrees to purchase products ("the products") from Agratech NW Ltd ("the Company"), trading as Agratech. No other terms or representations shall form part of these terms unless agreed in writing between you and the Company. These terms do not affect your statutory rights.

2. Purchasing from us

2.1 Ordering at Agratech NW Ltd is fast and secure. To place your order follow the steps indicated on-line.

2.2 The appearance of the products on this website is an invitation to you to make an offer for their purchase by placing an order with the Company. The Company has the right to refuse and refund orders, and no contract will subsist, between you and the Company, until The Company or one of its suppliers dispatches the product out to you. 

2.3 The products are subject to availability. If the Company does not supply the products to you for any reason, the Company will not charge you for these products and will refund any money already paid. However the Company will not be responsible for compensating you for any other losses which you may suffer if the Company does not supply the products.

2.4 You do not own the products until we receive payment in full.

2.5 Despite the fact that any contract relating to orders placed through this website is concluded over the Internet, we each agree that it has been concluded in the United Kingdom in writing. Any such contract will be interpreted, construed and enforced in all respects in accordance with English law and we each irrevocably submit to the non-exclusive jurisdiction of the English Courts.

2.6 Purchases of Pesticides - The purchaser and/or end users of the pesticide products being purchased are responsible for ensuring that these products are used in line with current industry Approved Codes of Practice. All operators must be certificated and trained in using and applying any Ministry Approved professional product. Please ensure that you use plant protection products safely. Always read the label and product information prior to each use. Please be aware that by proceeding with any order you are purchasing a professional pesticide product and must ensure that the end user of these products complies with the DEFRA/HSE Code for the Safe use of Pesticides and are qualified in the use of, and safe disposal of pesticides in accordance with FEPA.

3. Delivery

3.1 We endeavour to dispatch your order to you as soon as possible, subject to the receipt of cleared funds (We no longer accept cheques as payment for internet or telephone orders). However, because delay is sometimes outside of the Company's control, time of delivery shall not be of the essence. As such, the Company shall not be liable for any losses, costs, damages, charges or expenses caused by any delay in the delivery of the products. If you have not received the products within 28 days you may contact the Company by email quoting your order reference number and cancel that order. The Company will refund any money paid by you in relation to that order.

3.2 It is the responsibility of the customer to inspect the products immediately upon receipt. The Company will not be liable for loss or damage during transit unless you notify the Company in writing (including email) of the nature of the damage within 3 working days of the date of delivery. The liability of the Company will be limited to the replacement of products damaged or lost, and will credit you with the value of lost or damaged products at the Company's discretion. Under no circumstances shall the Company be liable for consequential loss or damage arising from loss or damage occurring in the course of carriage.

3.3 Failure to advise the Company of non-delivery of goods within 10 days from date for delivery specified in the order will relieve the Company of all responsibility and liability for loss. 

3.4  The Purchaser shall inspect the goods immediately on the arrival thereof and shall within 7 days from such inspection give notice in writing to the Company of any matter or thing by reason whereof he alleges that the goods are not in accordance with the contract if the Purchaser shall fail to give such notice the goods shall be deemed to be in all respects in accordance with the contract and the Purchaser shall be bound to accept and pay for the same accordingly.

b) It shall be the Purchaser's responsibility to return alleged defective goods to the Company at the Purchaser's expense. 

4. Pricing - Your Right to Cancel & Returns

4.1 The prices for the products are as indicated on the website and these prices exclude UK VAT at the current rate. Purchasers from outside the European Union will be able to see EX VAT prices and once you have reached the checkout and added your Address and country details, at which point the UK VAT will be added to the price of the products and the shipping charges, this will apply to all EU Countries. For EU Vat registered purchases from within the EU, excluding UK addreses, we can only deduct the VAT after you have set up an online account and supplied your EU vat number and we have then verified and approved it. After such time, all further purchases will be UK Vat free, for approved online account holders. By setting up an online account you will not receive a credit account, it is solely for the purpose of online purchases from this website. All purchases will still require payment in full at checkout.

4.2 The cost of any order must be paid by you up-front by a credit card, debit card or bank transfer - means acceptable to the Company before goods can be dispatched. We no longer accept Cheques.

4.3 While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

4.4 Due to circumstances beyond our control, prices may have to be altered up or down. If for this, or any other reason a product is not acceptable, the Company must be notified in writing (including email) within 7 working days of receipt, and the product may be returned within 14 days of receipt, for a refund to your credit/debit card account. Original outgoing shipping charges, stripe processing fees, and any re-stocking charges will will be deducted from any refund offered. This does not affect your statutory rights. The goods must be returned in an unopened and unused state. Any returned items that have been opened or deemed as used, will not be credited, unless by prior arrangement and acceptance by the company.

4.6 The Company will not be held liable for the loss in transit of any returned item(s). We advise you to ensure the products are adequately packed and insured during any return journey. We would also advise you to use a courier if you are unable to deliver the products personally.

4.7 If the Customer requires the products to be collected, the cost of this collection will be borne by the Customer. This will be deducted from any refund due.

4.8 If you require an alternative item please place a new order on our website.

4.9Returns of spray tips / sprayer nozzles. All of our Nozzles and Spray tips are manufactured as precision items, and they are supplied to you as such. They are dispatched in a sealed plastic bag. Once the sealed bag has been opened, the contents then become "Non Returnable and Non refundable". There are no exceptions to this rule. It is the responsibility of the user, to ascertain the suitability of any spray tips or nozzles prior to purchase.

5.0 Returns of special order items, or special products, are non returnable. Any items sold that are"non stock' and have to be order in especially, will be deemed as special order items.

5.1 Goods ordered in error, or are simply returned, because you have decided you do not want the goods after delivery, will be subject to a restocking fee of 20%, plus the outgoing postage costs, which will be deducted from your refund.

5.2 All UK, orders placed on the website, were payments are made via the Stripe payment gateway, and the customer then requests the order be cancelled and refunded, or incorrectly orders an item, and subsequently returns the unused item, for a refund, will be subject to a deduction of the Stripe processing fee of 2.5% plus £0.20.

This figure will be rounded down to the nearest full penny.

The Stripe card processing fee is non refundable. 

Your refund will take 10 working days, and will be credited back to the card used for the original payment. 

Orders placed from overseas, this fee will be higher and will vary dependant upon the country were the order was placed. Please copy and paste the stripe link below to see Stripe processing and transaction fees.

5.4 All goods supplied are subject to the manufacturers terms of supply and warranty, were applicable.

5. Defective or unsuitable goods

5.1 It is the responsibility of the customer to inspect the products on receipt of delivery or collection. The Company will not be liable for loss or damage during transit unless you notify the Company of the nature of the damage within 3 working days of the date of delivery or collection. If goods are found to be defective or faulty and you have notified us of any damage you, then have up to 14 days to return these goods to us for inspection and to rectify the problem. For any deliveries that arrive damaged, these MUST be signed for as damaged on the drivers tracking device upon receipts of goods. The recipient must not sign for any goods without declaring any damages. Failure to do so may inhibit and invalidate the claim for damage of goods. We also require a photograph(s) of the goods and packaging as they were received to be emailed to us immediately at sales@agratech.co.uk. We reserve the right to inspect all returned products prior to agreeing to any part-refund, full refund or product exchange.

5.2 There will be no refund or exchange for damage caused by accident, neglect or misuse. We reserve the right to credit the Customer with the value of lost or damaged products at our sole discretion.

5.3 The Company's liability in respect of any defective product is limited to its replacement and its cost of return. Carriage charges are non refundable.

5.4 Items supplied direct to customers from our suppliers, may have a higher carriage charge than that charged on the original order. Any items returned to our suppliers, by customers, for whatever reason, are the sole responsibility of the customer, until the item has been received back with our supplier. Your may refund will have the original carriage charge, charged by our supplier, deducted from your refund, and this may be more than you were charged when purchasing the item from our website.

6. Supply

We reserve the right to refuse to supply any individual or company.

7. General

Failure by the Company to enforce any of these terms will not affect its rights to enforce any of these terms at any time in the future. If at any time any of these terms or part of a term are/is found to be invalid or unlawful by any court then such term or part term shall be deemed severed from these terms and the remaining terms shall be deemed valid and subsisting. These terms are subject to change at any time without prior notice to you. The Company advises you to print and keep safe a copy of these terms.
